PRIVACY POLICY

Better Than Home, Inc., a Delaware corporation, and its affiliates (“we”, “us”, “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information when you interact with our websites (each individually and collectively, the “Site”) or use us for the provision of pet care at our facilities (the “Services”).

1.         Information We Collect

Information You Provide

Through your use of the Site or the Services, we may collect your personal information, including your:

  • Name
  • Email address
  • Telephone number
  • Billing address
  • Purchase history
  • Account login information (via Goose, Gingr, or other third-party service provider)
  • Communications you send to us

Automatically Collected Data

Using automatic data collection technologies we may collect the below information, which may include personal information:

  • IP address
  • Device and browser information
  • Cookie data
  • Approximate location
  • Pages and sites viewed, search terms, timestamps, and usage data

The technologies we use for this automatic data collection may include:

  • Cookies. A cookie is a small file placed on your device when you interact with the Site. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Site.
  • Web Beacons. Some parts of the Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking). Using automatic collection technologies helps us to load the Site correctly and perform analytics to optimize our Site.

To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may be able to opt out from use of these automated technologies for such uses by sending an e-mail to privacy@digsdogcare.com. Please note that some Site features may be unavailable as a result.

Third Party Data Collection

When you interact with the Site, there are third parties that may use automatic collection technologies to collect information about your or your device. These third parties may include:

·       Advertisers, ad networks, and ad servers.

·       Goose, Gingr, or other third-party booking service provider.

·       Third party providers for payment processing.

·       Analytics companies.

·       Your device manufacturer.

·       Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Site, including the third-party booking services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Your use of the third-party booking services available through our Site is governed by such third party’s privacy policies and terms of service. We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

2.         How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

·       Provide you with the Site and its contents, and any other information, products, or Services that you request from us.

·       Fulfill orders, process payments, arrange shipping, provide invoices and  order confirmations, communicate with you about your orders, and screen for potential risk or fraud.

·       For targeted advertising.

·       To text, call, or otherwise communicate with you for scheduling and other purposes related to the Services or the Site, as well as for marketing or advertising communications subject to your Choices Regarding Our Communications with You below.

·       Fulfill any other purpose for which you provide it.

3.         Disclosure of Your Information

We may disclose aggregated information about our users and customers, and information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or you provide:

·       To our subsidiaries and affiliates.

·       To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

·       To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Site and Services users is among the assets transferred.

·       To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use the notification feature of our Site (or a third party service provider through our Site), we will transmit the contents of that e-mail to the e-mail address provided.

·       For any other purpose disclosed by us when you provide the information.

·       With your consent.

We may also disclose your personal information:

·       To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

·       To law enforcement, animal control, medical or public health authorities, our insurers or legal counsel pursuant to a dog bite or other similar incident.

·       To enforce our rights arising from any contracts entered into between you and us, including the Assumption of Risk, Release from Liability, and Waiver Agreement and our  Terms of Service [link here], and for billing and collection.

·       If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. This further includes victims of dog bites  or other incidents, or their legal representatives, to facilitate a resolution to such incident.

4.         Choices You Make About How We Use and Disclose Your Information

Automated Site Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

·       Tracking Technologies. For our Site, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Site may then be inaccessible or not function properly.

·       Location Information. You can choose whether or not to allow the Site to collect and use real-time information about your device's location through the device's location or privacy settings. If you block the use of location information, some parts of the Site may become inaccessible or not function properly.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Choices Regarding Our Communications with You

By providing your phone number or e-mail to us, you agree to accept and receive communications from us or on our behalf, including via e-mail, text message (and similar messaging platforms (e.g., WhatsApp)), calls, in-app or Site communications, and push notifications to the telephone number(s) and e-mail addresses you provided to us. You may also receive communications generated by automatic telephone dialing systems and/or which will deliver prerecorded messages sent by or on behalf of us, including but not limited to communications concerning requests for our Services. Message and data rates may apply.

We may contact you using autodialed or prerecorded calls and text messages, at any telephone number that you have provided us, to: (i) notify you regarding your upcoming or past Services; (ii) troubleshoot problems with your account with us, if any; (iii) resolve a dispute; (iv) collect a debt; (v) infrequently poll your opinions through surveys or questionnaires; or (vi) as otherwise necessary to provide our Services, enforce our Terms of Service, our policies, applicable law, or any other agreement we may have with you. If you affirmatively opt in to such practices, we may also contact you using autodialed or prerecorded calls and text messages for marketing purposes (e.g., offers and promotions). We may collect other telephone numbers for you and may place manual non-marketing calls or texts to any of those numbers and autodialed non-marketing calls to any landline. Standard telephone minute and text charges may apply and may include overage fees if you have exceeded your plan limits.

·       E-mail. If you no longer want to receive marketing and promotional emails from us, you may click on the “unsubscribe” link in the e-mails to opt-out of future marketing email communications. Please consult our third party service providers applicable privacy policies to determine how to opt out of marketing and promotional e-mails sent from such providers, as we have no control over their marketing and promotional e-mail materials. Please note that even if you opt out of receiving marketing communications, we may still send you Service-related communications, such as confirmations of any future reservations you make with us.

  • Push Notifications (on Mobile Devices). You can use the settings on your mobile device to enable or turn off mobile push notifications from us.
  • Text Messages. We will not send marketing or promotional text messages to you unless you have affirmatively opted-in to receive such text messages from us. For purposes of clarity, certain text messages between you and us are transactional text messages related to our Services, not promotional text messages, and your provision of your phone number to us constitutes consent for us to contact you with such transaction text messages.  If you have opted in but no longer want to receive promotional and marketing text messages from us, reply “STOP” to the message. After you send the text message "STOP" to us, we will send you a text message to confirm that you have been unsubscribed. After this, you will no longer receive promotional and marketing text messages from us. If you want to join again, just opt in as you did the first time and we will start sending promotional and marketing text messages to you again. If you have created an account with a third-party service provider to obtain or use our Services, please consult their applicable privacy policy or site to opt out of promotional and marketing texting from them. You acknowledge that opting out of receiving all communications may impact your use of the Services. Notwithstanding the foregoing, if we suspect fraud or unlawful activity, we may contact you using any of the contact information you provided to us (including via text or voice-recorded message).

5.         Accessing and Correcting Your Personal Information.

You can review and change your personal information by logging into the Site and/or third-party service provider site and visiting your account profile page. For any information provided offline, you can call or visit us in person to correct your personal information.

You may also send us an e-mail at privacy @digsdogcare.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

6.         Your State Privacy Rights.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

Many states, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

·       Confirm whether we process their personal information.

·       Access and delete certain personal information.

·       Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

·       Data portability.

·       Opt-out of personal data processing for:

·       targeted advertising (excluding Iowa);

·       sales; or

·       profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).

·       Either limit (opt-out of) or require consent to process sensitive personal data or process personal data of minors under 18, 17, or 16 years old.

The exact scope of these rights may vary by state. To exercise any of these rights, please write us at privacy@digsdogcare.com. To appeal a decision regarding a consumer rights request please write us at privacy@digsdogcare.com.  If unsatisfied with our response, you may lodge a complaint with your local data protection authority.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: privacy@digsdogcare.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

7.         Data Security.

We use commercially reasonable administrative, physical, and technical measures designed to protect your information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site or Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the  Site.

8.         Changes to Our Privacy Policy.

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, it is our policy to notify you in compliance with the law.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you and for periodically visiting this privacy policy to check for any changes.
